Most ILR applications succeed, but refusals do happen. Understanding the most common reasons can help you avoid a costly mistake. Here are the most frequent issues flagged by immigration lawyers.
1. Excess absences
Exceeding the 180-day rolling limit or the overall 450-day cap is the single most common reason for refusal. Often, applicants genuinely didn’t realise they had crossed the line — which is why accurate tracking from the start is essential.
2. Inaccurate travel history
Even when absences are within limits, listing them incorrectly on the application form can cause problems. The Home Office cross-references against border records. Discrepancies can lead to refusal or, worse, a finding of deception.
3. Broken continuous residence
A short gap between visa expiry and renewal, or an earlier visa refusal on the record, can break continuous residence. Settlement requires an unbroken 5-year (or longer) period of lawful residence.
4. Failing the English language requirement
Most applicants must prove B1 English. Some forget to include the test certificate or submit one that doesn’t meet the Home Office’s approved list. Check the current approved providers.
5. Failing the Life in the UK test
Forgetting to take the test, or submitting an expired certificate (it doesn’t actually expire, but providing the wrong certificate number happens) causes issues. Always submit the correct pass notification.

8. Missing documents
