From ILR to British Citizenship: Absence Rules You Need to Know

Once you have ILR, British citizenship is the next step. Learn about the different absence limits for naturalisation and how to stay on track.

Congratulations on getting your Indefinite Leave to Remain! For many people, the next goal is British citizenship through naturalisation. But before you apply, there’s another set of absence rules you need to be aware of.

Citizenship absence requirements

The absence rules for British citizenship are stricter than those for ILR. Here’s what the Home Office expects:

  • No more than 450 days outside the UK during the 5-year period before your application
  • No more than 90 days outside the UK in the last 12 months before your application

These requirements apply to naturalisation under Section 6(1) of the British Nationality Act 1981.

The 90-day rule in the final year

The 90-day limit in the final year is the one that catches people out most often. After years of relatively generous travel allowances, many applicants don’t realise they need to significantly reduce their time abroad in the year leading up to their citizenship application.

Planning ahead

If you’re thinking about applying for citizenship, start planning your travel at least 12-15 months in advance. This gives you a buffer to ensure you meet the 90-day requirement.

How is the qualifying period calculated?

For citizenship by naturalisation, the qualifying period is the 5 years ending on the date of your application. Unlike ILR, where the qualifying period is fixed to your visa start date, the citizenship qualifying period is flexible — you choose when to apply.

This means you can time your application strategically to ensure your absences fall within the allowed limits.

What about discretion?

The Home Secretary has discretion to overlook excess absences in certain circumstances. However, the current guidance suggests this discretion is exercised sparingly. You shouldn’t rely on it.

Factors that may support a request for discretion include:

  • Strong ties to the UK (family, property, employment)
  • Absences were for work required by a UK employer
  • Only slightly over the limit
