Innovator Founder Visa: Absence Rules and Settlement
A practical guide to the Innovator Founder visa absence rules, the 3-year ILR route, and how to track your time outside the UK.
The Innovator Founder visa replaced the older Start-up and Innovator routes in April 2023. It allows entrepreneurs with an innovative business idea to establish and grow a company in the UK — and settle after just 3 years.
The 3-year ILR route
One of the most attractive features of this visa is the accelerated path to settlement. You can apply for Indefinite Leave to Remain after 3 years of continuous residence, rather than the usual 5.
Absence rules
The absence rules for the Innovator Founder visa are consistent with most settlement routes:
- Maximum 180 days outside the UK in any rolling 12-month period
- Continuous residence of 3 years
Because the qualifying period is shorter, you have less room for error. Exceeding 180 days in any single 12-month window could delay your settlement by another 3 years.
Business travel abroad
Founders often travel to raise investment, meet clients, or attend conferences. These business trips all count as absences. The Home Office does not distinguish between business and personal travel when counting days.
If your business requires frequent international travel, consider:
- Using video calls where possible to reduce trips
- Combining multiple meetings into single trips
- Building a track record of UK-based operations
Endorsement and growth requirements
Alongside absence limits, ILR on this route requires that your business meets certain growth criteria, endorsed by an approved body. Settlement requirements include:
- Significant business progress (turnover, job creation, investment, or innovation)
- Continued endorsement from your endorsing body
- Active involvement in running the business
Spending too much time abroad could also undermine your ability to demonstrate active engagement with your UK business.
